The issue has to something else. If a user just uploads an image but then leaves the page without saving it, the user's image counter is not increased as this counter is increased during saving the image data.

I dont know what the user did, yet the images shows in phpmyadmin but not on the front end. So something went wrong.

Does the tmpHash column of that image has a value? All images in the, as you call it, "temp state" have a tmpHash, all properly saved images do not.

Well it did, its now not in phpmyadmin anymore...
The activity points system still reports that the user has 1 image etc, yet they clearly dont.

Is it possible that the issue might be caused by an older image (that has just been deleted in the database or during whose deletion an error occurred)?
An issue with this specific image is unlikely as the order in the code is to first "empty" the value tmpHash and then increase the user's image counter. If an error occurred, it must have occurred before the tmpHash was emptied so that also the image counter has not been increased.

Have you rebuild the data in the ACP?

Yes, since I noticed the tmp hash image has vanished a counter rebuild cleaned up the remaining issue.
Do these rebuild data counters run automatically too? Like when threads are deleted etc will they update without me running them manually?

No, they do not run automatically, as the code for deleting a thread takes care of that automatically. But, when issues occur or after imports, they can be run manually to update the system.
For now, I will mark this problem as non-reproducible. If this issue should appear again, please report back with as much information as possible
